Our Labour & Employment practice provides monthly compliance management, advisory services, drafting of agreements & manuals and litigation. Labour or Employment Law in Indian context comprises Central Laws and State Specific Laws. Applicability of such laws depends on factors like nature of industry, employee/worker head count and age, mode of engagement of workforce. We have profound experience in advising the clients in matters pertaining to employees’ provident fund, Employee State Insurance and matters pertaining to industrial relations.
In addition to the above services, we have been providing our services to the clients in M & A transactions, closure of industrial under taking, shifting of industrial undertaking from one state to other etc. Further, we have been advising the clients in redundancy process (retrenchment in the Indian context).
To summarize, our services consisting of the following:
1. Employment Agreements:
Drafting of employment agreements, employee hand books, HR manuals, HR policies etc. in line with the Indian Labour Laws.
2. Monthly PF & ESI compliance:
Providing advisory support with respect to PF & ESI in assessing the monthly provident fund and ESI dues on appropriate salary components to avoid departmental action and assisting in monthly PF & ESI filings.
3. Representation:
We are representing the clients before Provident fund, ESI and Labour authorities for any quasi-judicial proceedings under respective enactments, replying to show-cause notices etc.
4. Labour Law advisory:
Advising the clients on wide range of labour laws such as the Industrial Disputes Act, 1947, the Employees' Provident Fund & Miscellaneous Provisions Act, 1952 Act, The ESI Act, 1948, the Factories Act, 1948, the Trade Unions Act, 1926, the Payment of Bonus Act, 1965, the Payment of Gratuity Act, 1972, the Contract Labour Act, 1970 and the state specific enactments such as Shops & Establishments enactments, Labour Welfare Fund Acts etc.
5. Employee compensation & Benefits:
Designing the employee benefits and compensation in compliance with the social security enactments like Employees’ Provident Fund Act, ESI Act, Payment of Bonus Act etc.
6. Obtaining required licenses:
We assist the clients in setting up of business in any state of India by obtaining required licences and registrations from the appropriate authorities.
7. Employee downsizing:
Advisory support in employee termination and downsizing. We have been proving advisory services in downsizing by terminating the redundant workforce as per the applicable labour enactments, Supporting the clients during quasi-judicial hearings with the labour authorities.
8. Closure/transfer of undertakings:
Advising the clients in case of closure of undertaking, transfer of under taking, relocation of undertaking from one state to other, transfer of employees in acquisitions, mergers and legal implications arising out of such transactions.
9. Legal Audits:
We do periodic legal audits for clients in respect of Central and State specific labour enactments. Legal audits help the clients in course corrections and to minimize the impact on the establishments.
10. Litigation:
We are providing litigation support to the clients under labour laws with appropriate litigation strategy. Our service comprises of drafting petitions, responding to show-cause notices, representing the clients before the forums like CGIT, Labour Courts/Tribunals and High Courts.
11. Patent Prosecution:
We are supporting the clients in drafting of claims and filing of patent applications and representing the clients before the authorities.
